1. Introduction
These Property.new Buyer Terms ("Buyer Terms") govern your use of Property.new ("the Service"), the buyer-facing real estate marketplace operated by Cladbe Platforms LLP ("Cladbe", "we", "us", or "our"), a limited liability partnership incorporated under the Limited Liability Partnership Act, 2008, with its registered office at Tulsi Nagar, Bareilly, Uttar Pradesh – 243006, India.
Property.new is accessible at www.property.new and via the Cladbe mobile application. The Service helps you discover, evaluate, and enquire about real estate projects across India, and where you choose to proceed, submit an Expression of Interest ("EOI") and pay Token Money toward a specific unit.
By accessing or using Property.new, you confirm that you have read, understood, and agree to be bound by these Buyer Terms, our Property.new Buyer Privacy Notice, Property.new Buyer Cookie Notice, and Property.new Buyer Refund & Cancellation Policy. These four documents together govern your use of Property.new as a buyer. If you do not agree to these Buyer Terms in their entirety, please do not use the Service.
Important to know: Property.new is a marketplace. We connect you with builders and channel partners — we do not sell property ourselves. Every transaction is between you and the builder you choose. We facilitate the journey; we do not own or develop the projects you see.
2. Definitions
In these Buyer Terms, the following capitalised terms carry the meanings set out below. Other defined terms used in these Buyer Terms but not defined here carry the meanings given to them in the Master Terms of Use available at cladbe.com/terms.

| Carpet Area | The net usable floor area of an apartment, as defined under Section 2(k) of RERA, excluding external walls, services shafts, exclusive balconies/verandahs, and exclusive open terraces, but including internal partition walls. |
| EOI / Expression of Interest | Your formal, digital indication of interest in purchasing a specific unit, submitted through Property.new. |
| Token Money | The booking amount you pay toward a unit upon EOI confirmation or unit blocking. Token Money is held by an RBI-licensed Payment Aggregator or the Builder's RERA project account, not by Cladbe. |
| Convenience Fee | The non-refundable technology infrastructure fee charged by Cladbe per online unit blocking or EOI submission, distinct from Token Money. |
| Listing | A real estate project displayed on Property.new. Listings carry different verification levels, explained in Section 6. |
| Master Policies | The four master legal documents that apply across the entire Cladbe ecosystem: the Master Terms of Use, Master Privacy Policy, Master Cookie Policy, and Master Refund & Cancellation Policy, all available at cladbe.com. |
3. Who Property.new Is and Isn't
3.1 What We Are
Property.new is a real estate marketplace and information platform. Projects appear on Property.new through more than one route: some are compiled from publicly available records (such as State RERA registries and Development Authority portals for government housing schemes), and others are onboarded directly by Builders who bring their projects to the platform. A project may therefore appear on Property.new whether or not any prior public listing of it existed.
Where a project is required by law to be registered under the Real Estate (Regulation and Development) Act, 2016, a listing for it will reference that registration. Not all real estate is subject to mandatory RERA registration — registration requirements depend on factors such as project size, unit count, construction status, and applicable State rules and exemptions. You should verify the registration status and details of any project directly with the applicable State RERA Authority and the Builder before transacting.
Cladbe operates Property.new as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000, and claims the benefit of safe harbour protection under Section 79 of the IT Act in respect of third-party content displayed on the Service.
3.2 What We Are Not
Property.new is not a real estate developer, promoter, broker, financial advisor, or legal advisor. We do not own, develop, build, sell, lease, or guarantee any of the projects listed on the Service. We do not represent the Builder, and the Builder does not represent us. All commercial, contractual, and possession obligations relating to your purchase are between you and the Builder.
We do not provide investment advice, property valuation, or assurance of return on investment. Any market data, price trends, or comparative analytics shown on Property.new are for informational purposes only and do not constitute a recommendation to transact.
Verify before you commit. Information on Property.new is curated from public records and Builder submissions. Before paying any Token Money or signing any agreement, please verify project details (RERA registration, sanctioned plans, approvals, possession timelines) directly with the source State RERA portal and the Builder. We strongly encourage independent legal and financial advice for any property transaction.
4. Account Creation, Sign-In, and KYC
4.1 Anonymous Browsing
You may browse Property.new without creating an account. Anonymous browsing covers the homepage, project search and filter tools, most project listing pages, Government Scheme listings, and read-only access to the Property.new AI Assistant.
4.2 When Sign-In Is Required
You must sign in to access the following features:
- Saving favourites, comparison lists, or alerts;
- Contacting a Builder or Channel Partner through the Service;
- Submitting an Expression of Interest (EOI);
- Paying Token Money or any other amount through the Service;
- Viewing Trust Score and Verified-listing details;
- Participating in any Flash Sale, Limited-Time Inventory Sale, or other time-bound campaign;
- Viewing Mortgage Buyability Calculator results;
- Accessing the My Home App and post-purchase services.
4.3 How Sign-In Works
Property.new uses mobile phone number with one-time password (OTP) verification as the sole sign-in mechanism. We collect your phone number to (a) ensure you are an actual KYC-verified user and not an automated bot, (b) communicate transactional updates to you, and (c) connect you with the fulfillment channel — Builder, authorised Channel Partner, or Experience Centre team — that handles your enquiry or EOI.
Single-sign-on through Google, Apple, Facebook, or any other third-party identity provider is not offered on Property.new. This is deliberate — phone-OTP verification provides a stronger baseline of identity confidence for property transactions, where the financial stakes are high.
4.4 What We Collect, When
We collect identity information from you in stages, only as required for the next step you choose to take:

4.5 Account Responsibility
You are responsible for keeping your registered phone number current and for safeguarding access to the device that receives OTPs. You agree to (a) provide accurate, current, and complete information at the time of EOI submission and Token Money payment; (b) promptly update your information if it changes; (c) not impersonate any other person or use another person's phone number; (d) immediately notify us at grievance@property.new if you suspect unauthorised access to your account, so we can act on a potential security incident under our DPDPA breach-response process.
4.6 Eligibility
To submit an Expression of Interest, make any payment, or transact through Property.new, you must be at least eighteen (18) years of age and competent to contract under the Indian Contract Act, 1872. Minors (individuals under 18) may browse Property.new and explore project information — we recognise that children often have a meaningful voice in family property decisions — but cannot create transactional accounts, submit EOIs, or make payments. Where a property is being purchased in the name of a minor, the legal guardian must create the account in the guardian's own name, with the guardian bearing full contractual responsibility under these Buyer Terms.
5. How Property.new Works
5.1 Browsing and Search
Property.new lets you search and filter real estate projects by location, configuration, budget, possession timeline, developer, RERA status, and other parameters. Search results display project listings carrying different verification levels, each indicating how much the listing has been confirmed and how much you should independently verify (see Section 6).
5.2 Submitting an Expression of Interest (EOI)
When you find a project of interest, you may submit an EOI. The EOI is a formal, digital indication of your interest in purchasing a specific unit. Submitting an EOI does not create a binding contract to purchase. The binding contract is the Builder-Buyer Agreement, which you sign directly with the Builder after EOI confirmation.
When you submit an enquiry or EOI, you are making a request to Cladbe to help you find and buy property. You are not enquiring directly to the Builder. On receiving your request, Cladbe routes your details (name, phone, email, requirement, budget, EOI value, source listing, attribution timestamp) to whichever fulfillment channel — the Builder, an authorised Channel Partner, the Cladbe Experience Centre team, or a combination of these — is best positioned to help you. This routing is not limited by the claim status of the listing, and the party who assists you may help you with the project you enquired on and with comparable or alternative projects matching your requirement. Where a Channel Partner or the Experience Centre team is the party assisting you with a booking, they will also receive the KYC documentation needed to assess and process that booking. By submitting an enquiry, you consent to this routing and handling; if you do not want your details shared with these fulfillment channels, please do not submit an enquiry — you can still browse Property.new.
5.3 Token Money and Unit Blocking
Where the project supports digital unit blocking, you may proceed to pay Token Money toward a specific unit. Token Money payment is processed by an RBI-licensed Payment Aggregator, with funds routed either to the Builder's RERA-compliant project account (under Section 4(2)(l)(D) of RERA) or to an escrow account, depending on the project structure.
Cladbe does not hold your money. Cladbe acts as the technology orchestration layer. Your Token Money, booking amounts, and any other principal funds you pay through Property.new are held and processed exclusively by RBI-licensed Payment Aggregators and the Builder's designated RERA project or escrow account. Cladbe never holds, pools, or controls your principal funds. Cladbe's own service fees (such as the Convenience Fee) are collected by the same Payment Aggregator framework with Cladbe as a sub-merchant.
5.4 Convenience Fee
Property.new charges a non-refundable Convenience Fee per online unit blocking or EOI submission, as a technology infrastructure fee distinct from the Token Money payable to the Builder. The Convenience Fee amount is disclosed clearly at the time of the relevant transaction, before you confirm payment. The Convenience Fee is non-refundable in all circumstances, including where the Builder declines your EOI.
5.5 Other Fees Charged by Builders or Development Authorities
Beyond Token Money and the Convenience Fee, Builders frequently charge separate fees at various stages of the transaction — application fees, processing fees, documentation or legal scrutiny fees, and loan-processing fees where you opt to use the Builder's tied lender. Development Authorities charge separate application fees, registration fees, and Earnest Money Deposit (EMD) on Government Scheme listings.
These third-party fees are paid directly to the Builder or to the relevant Development Authority — not to Cladbe. Cladbe does not collect, hold, route, or refund these fees. Their amount, applicability, and refundability are governed by the Builder's project-specific terms or the Development Authority's scheme rules, which are typically structured as non-refundable. The Builder or Authority is required to disclose all such fees to you in writing before you pay; please read those disclosures carefully and confirm what is and is not refundable before making any payment.
5.6 What Happens After EOI
After you submit an enquiry or EOI, the fulfillment channel handling your request — the Builder, an authorised Channel Partner, or the Cladbe Experience Centre team — will contact you to assist with your property requirement. Your request may be accepted (subject to availability, pricing confirmation, and KYC), countered, or declined. Where an EOI is declined, Cladbe will instruct the Payment Aggregator to refund the Token Money you paid, subject to the project-specific terms displayed at the time of payment. Cladbe's role in such refunds is limited to instruction and orchestration through the Payment Aggregator framework.
Where the Builder accepts your EOI, you will proceed to execute a Builder-Buyer Agreement with the Builder directly. Cladbe is not a party to the Builder-Buyer Agreement. From that point onward, all commercial, contractual, and possession matters are governed by the Builder-Buyer Agreement and applicable RERA provisions, and are between you and the Builder.
6. Listing Verification Levels
Not all listings on Property.new carry the same level of confirmation. To help you judge how much to rely on a listing and how much to verify independently, listings are presented at one of the following levels.
6.1 Listed (Information) Listings
These listings present project information that has been compiled from publicly available records and other sources, and has not been confirmed by the Builder. They are intended to help you discover projects. Cladbe does not warrant the accuracy, completeness, or currency of such listings beyond reasonable care, and you should verify all details independently with the Builder and the applicable State RERA Authority before acting on them.
6.2 Verified Listings
These listings have been confirmed by the Builder, who has provided project content and details, and may include confirmed availability, richer media, a Trust Score, and additional features such as instant booking or pre-approval workflows where available. A Verified status reflects that the Builder has confirmed the listing at the time of display; it may be removed if that confirmation is no longer current. Verified status indicates Builder confirmation only — Cladbe does not independently verify or endorse the underlying project content.
6.3 Government Scheme Listings
These listings present statutory government housing scheme offerings sourced from official Development Authority portals (such as DDA, YEIDA, and NOIDA Authority). They serve discovery purposes only — Cladbe does not represent any Development Authority, does not process applications, allotments, or payments for such schemes, and routes interested buyers to the official portal of the relevant Authority for application and transaction handling.
Application fees, registration fees, EMD, and other charges levied by a Development Authority for scheme participation are paid directly to the Authority through its official portal, are governed entirely by the Authority's scheme terms, and are typically non-refundable. Cladbe has no role in collecting, holding, processing, or refunding such fees, and bears no responsibility for the outcome of any Authority allotment process.
Verified status is a confirmation signal, not a quality guarantee. A Verified status means the Builder has confirmed the listing at the time you see it. It is not an endorsement of project quality, builder reputation, possession timelines, or commercial terms. Where a Trust Score is shown, it is an objective composite of operational factors (such as delivery history, RERA compliance signals, and customer feedback) — please read the score breakdown for context, and always verify project details independently before you commit.
6.4 Promoted and Featured Listings
Some listings on Property.new are promoted. Builders may pay for promotional visibility — for example, featured placement, homepage spotlight, or sponsored positioning. Promotion works in two ways: (a) promoted listings may appear in dedicated promotional slots; and (b) payment may improve a listing's position or prominence in search and browse results. In every case, promoted listings are clearly labelled — for example as "Featured", "Sponsored", or "Promoted" — so you can always tell paid placement from ordinary results.
Promotion is a commercial arrangement and nothing more. A promoted or featured listing is not necessarily more verified, more reliable, or endorsed by Cladbe, and promotion is available across listing verification levels — meaning a promoted listing may still be a "Listed" (unconfirmed) listing rather than a Verified one. Promotion affects only visibility and placement; it does not change a listing's verification level, and it is not a recommendation by Cladbe to transact. You should apply the same independent verification to a promoted listing as to any other, and check its verification level (Section 6.1–6.3) before relying on it.
Cladbe also advertises projects and the Property.new platform on third-party channels — including search engines and social media platforms such as Google, Meta, and LinkedIn — to help buyers discover listings. How we use cookies and similar technologies in connection with this advertising, and how you can control it, is explained in the Property.new Buyer Cookie Notice and the Property.new Buyer Privacy Notice.
7. Your Use of the Service
7.1 Permitted Use
You may use Property.new for your personal, non-commercial purpose of evaluating, enquiring about, and where you choose, transacting in real estate, where you have a bona fide interest as a prospective Buyer. This permission does not extend to commercial exploitation of the Service or its content.
7.2 Prohibited Conduct
You must not:
- Use, copy, redistribute, retransmit, scrape, harvest, or commercially exploit any listing, project information, photograph, render, brochure, video, or other content displayed on Property.new for any purpose other than your personal, non-commercial evaluation of a specific real estate transaction in which you have a bona fide interest;
- Use the Service to build a competing product, benchmark our Service against competitors, or aggregate our listing data into a third-party product;
- Submit false, misleading, or impersonated EOIs, or use the Service to test, manipulate, or interfere with Builder pricing, lead allocation, or inventory systems;
- Submit content that is unlawful, defamatory, obscene, hateful, infringes third-party intellectual property, violates any other person's privacy, or breaches applicable advertising or consumer protection law;
- Use any automated system, bot, scraper, crawler, or off-the-shelf data extraction tool to access, monitor, or copy any part of the Service, except for publicly indexable content via standards-compliant search engine crawlers;
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying structure of the Service;
- Exceed reasonable usage thresholds (search frequency, API call rates, message volumes) communicated by Cladbe from time to time, or use the Service in a manner that imposes disproportionate burden on platform infrastructure.
7.3 Account Suspension
Cladbe reserves the right to suspend or terminate your account, with or without notice, where we reasonably believe you have violated these Buyer Terms, are engaged in fraudulent or illegal activity, or are using the Service in a manner that causes harm to other users, Builders, or Cladbe. Where Cladbe terminates your account for cause, any pending refunds will be processed in accordance with the Property.new Buyer Refund & Cancellation Policy, and no further refunds or compensation are payable.
8. Listing Data and Marketing Material Disclaimers
8.1 Personal, Non-Commercial Use of Listing Data
All project information, photographs, renders, brochures, videos, floor plans, area calculations, prices, and other content displayed on Property.new is licensed to you for your personal, non-commercial evaluation of a specific real estate transaction in which you have a bona fide interest. You may not copy, redistribute, retransmit, store, archive, or commercially exploit this content for any other purpose. This restriction applies to manual extraction as well as to automated systems and aggregator services.
8.2 Marketing Materials Are Indicative
Computer-generated images, walkthroughs, renders, artist's impressions, brochures, floor plans, and interactive plans displayed on Property.new are indicative only and may differ from the actual built form. Photographs marked as "stock image" or unmarked third-party visuals are illustrative and not representative of any specific project, unit, or amenity.
8.3 Subject to Change
Design, specifications, layouts, amenities, area calculations, prices, payment plans, and possession timelines displayed on Property.new are subject to change without prior notice and are governed by the final Builder-Buyer Agreement and the sanctioned plans approved by the applicable RERA. You are advised to verify all material details with the source RERA registry and the Builder before entering into any transaction, and are deemed to have done so prior to any payment or commitment made through the Service.
8.4 Carpet Area Disclosure
Where project area is displayed on Property.new, Carpet Area shall mean the net usable floor area of the apartment as defined under Section 2(k) of RERA. Where super built-up area or other area metrics are displayed alongside Carpet Area, you are advised to confirm the carpet-area figure with the Builder and against the RERA-registered sanctioned plans, as legal entitlement under RERA is based on Carpet Area.
9. Property.new AI Assistant
Property.new makes available an AI Assistant on the homepage, the buyer journey pages, and selected project detail pages. The AI Assistant is an automated assistant that answers factual questions about projects listed on Property.new — for example, configuration, amenities, RERA registration status, location, and price range.
The AI Assistant is non-personalised. It answers from Property.new's structured listing data only. The AI Assistant does not:
- Quote interest rates, EMI amounts, or any other lending product terms;
- Issue pre-approvals or loan eligibility statements;
- Make investment recommendations, price predictions, or rate-of-return projections;
- Provide legal, tax, or financial advice;
- Discuss properties not listed on Property.new.
Where you ask a question outside the AI Assistant's scope, the assistant will tell you it cannot help with that and route you to our customer support team. Complex queries are escalated to a human team member.
AI Assistant responses are generated by a third-party large language model provider engaged by Cladbe under a commercial API arrangement. The current provider does not retain or train on Property.new queries beyond what is required to deliver the API response, under the contractual data-protection terms in place. The identity of the current LLM provider is recorded in Cladbe's Sub-Processor Register, available on written request to grievance@property.new. Information you provide to the AI Assistant should not include sensitive personal data.
10. Mortgage Buyability Calculator
Property.new makes available a Mortgage Buyability Calculator ("Buyability Widget") on selected project pages and at the EOI flow. The Buyability Widget helps you assess affordability and provides indicative pre-approval information based on details you choose to share.
The Buyability Widget operates strictly within the scope of a Direct Selling Agent (DSA) arrangement under the Reserve Bank of India's Digital Lending Directions, 2025. Cladbe's role is limited to (a) capturing your basic eligibility information; (b) running an indicative pre-approval check with one or more partner lenders; and (c) routing you to the partner lender's own application interface for the formal loan application.
Cladbe is not your lender. Cladbe is not a regulated lender and does not participate in the loan principal flow. Any home loan you take is between you and the partner lender. The interest rate, EMI amount, processing fee, loan tenure, sanction terms, and disbursement schedule are determined by the partner lender. Cladbe does not guarantee loan approval, the rate you will receive, or that the indicative pre-approval will translate into an actual sanctioned loan. The Buyability Widget result is not a binding offer.
Where you proceed with a partner lender through the Buyability Widget, Cladbe receives a DSA commission from the partner lender — this commission is paid by the lender, not by you. The existence of this commission does not affect the terms you receive from the lender or the partner-lender shortlist shown to you (which is based on product fit and eligibility, not commission paid to Cladbe).
Any fees charged by the partner lender in connection with your loan — including login, processing, administrative, and valuation fees — are paid directly to the lender, are governed by the lender's own terms, and are typically non-refundable. Cladbe does not collect or refund lender fees. For how lender fees are treated on refund, see Section 5.3 of the Property.new Buyer Refund & Cancellation Policy.
11. NRI, OCI, and PIO Buyers
Non-Resident Indians ("NRIs"), Overseas Citizens of India ("OCIs"), and Persons of Indian Origin ("PIOs") using Property.new for property purchase in India represent and warrant that:
- They comply with all applicable provisions of the Foreign Exchange Management Act, 1999 ("FEMA") and the rules and regulations made thereunder;
- All payments toward the property — including Token Money, booking amount, and instalments — shall be routed exclusively through FEMA-compliant banking channels (NRO, NRE, or FCNR accounts, as applicable, or inward remittance through normal banking channels);
- They are not citizens of, or entities incorporated in, any country prohibited from acquiring immovable property in India under the FEMA non-resident property acquisition rules;
- They shall obtain all necessary RBI approvals, where required, or comply with general/automatic route permissions, before initiating any transaction;
- They shall ensure that the source of funds is lawful and traceable, and they shall provide source-of-funds documentation to the Builder and any applicable authority where required.
Cladbe is not responsible for verifying FEMA compliance and shall not be liable for blocked remittances, regulatory penalties, transaction failures, repatriation restrictions, or tax exposure arising from any NRI / OCI / PIO buyer's non-compliance with FEMA or any related regulation.
13. Refund and Cancellation
Refund and cancellation rights on Property.new are governed by the Property.new Buyer Refund & Cancellation Policy, available at property.new/refund and incorporated into these Buyer Terms by reference. The Buyer Refund & Cancellation Policy covers EOI Token Money refunds (including in the event the Builder declines your EOI), cancellation after the cooling-off period (where applicable), buyer default scenarios, refund processing timelines, Convenience Fee non-refundability, and your statutory rights under Section 18 of RERA where applicable.
Please read the Property.new Buyer Refund & Cancellation Policy before paying any Token Money. In short:
- Token Money is refundable where the Builder declines your EOI, subject to the project-specific terms displayed at the time of payment;
- The Convenience Fee is non-refundable in all circumstances;
- Any cooling-off period applicable to your booking is determined by the Builder-Buyer Agreement — there is no Cladbe-imposed cooling-off period at the platform level;
- Your statutory rights under Section 18 of RERA — including the right to refund with interest in the event of project delay — are enforceable directly against the Builder per the applicable State RERA Rules, and are not waived or limited by these Buyer Terms or the Buyer Refund & Cancellation Policy.
14. Intellectual Property
All intellectual property in Property.new — including the trademarks "Property.new" and "Cladbe", the look and feel of the Service, the underlying software, algorithms, data models, and aggregated insights — is owned by Cladbe or its licensors. Your use of the Service does not grant you any ownership, licence, or other right in any of these intellectual property assets, beyond the limited right to use the Service as set out in Section 7.
Listings displayed on Property.new contain content that is owned by the respective Builder (project photographs, brochures, renders, marketing copy) or sourced from public regulatory disclosures (RERA registration details). You may not copy, redistribute, retransmit, or commercially exploit any such third-party content beyond your personal, non-commercial evaluation of a specific real estate transaction.
15. Disclaimers and Limitation of Liability
15.1 AS IS Service
Property.new is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, Cladbe disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, non-infringement, and uninterrupted availability.
15.2 No Endorsement
The display of any project, Builder, Channel Partner, or third party on Property.new does not constitute an endorsement, verification, or recommendation by Cladbe of that project, Builder, Channel Partner, or third party. You are solely responsible for your decision to engage with any Builder or to transact in any project.
15.3 Limitation of Liability
To the fullest extent permitted by applicable law, the total aggregate liability of Cladbe to you, arising out of or in connection with your use of Property.new, shall not exceed the lesser of (a) the total Convenience Fees actually received by Cladbe from you in the three (3) months immediately preceding the event giving rise to the claim, or (b) Indian Rupees Ten Thousand (₹10,000). For buyers who have paid no Convenience Fee to Cladbe, Cladbe's total aggregate liability shall be nil. The limitations in this Section 15.3 do not apply to (i) Cladbe's liability for fraud, gross negligence, or wilful misconduct, (ii) death or personal injury caused by negligence, or (iii) any liability that cannot be excluded or limited under applicable Indian law.
15.4 No Indirect Damages
In no event shall Cladbe be liable for any indirect, consequential, incidental, punitive, exemplary, or special damages, including lost profits, lost business opportunities, lost data, lost goodwill, or diminution in property value, even if Cladbe has been advised of the possibility of such damages.
15.5 Builder Disputes
Any dispute relating to the underlying real estate transaction — including allotment, pricing, possession, construction quality, amenities, or delivery delay — is between you and the Builder. Cladbe is not a party to such disputes. Where you have a grievance against the Builder, you should pursue it directly with the Builder, through the applicable State RERA Authority, through the Consumer Protection Act forums, or as advised by your legal counsel. Cladbe's grievance redressal process (Section 16) addresses grievances about Cladbe's own service, not Builder disputes.

For privacy-related grievances specifically (DPDP Act rights, data access, correction, erasure), you may write to grievance@property.new with the subject line beginning "Privacy:" for prioritised handling. For data protection grievances unresolved by Cladbe, you may escalate to the Data Protection Board of India once it becomes operationally functional.
For property-transaction disputes between you and a Builder, the appropriate forums are the State RERA Authority of the relevant state, the Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or civil courts of appropriate jurisdiction — not Cladbe's grievance channel.
17. Governing Law and Dispute Resolution
17.1 Governing Law
These Buyer Terms are governed by, and shall be construed in accordance with, the laws of the Republic of India. The applicable State RERA, the Consumer Protection Act, 2019, the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, and other applicable Indian laws shall apply to your use of the Service.
17.2 Geographic Scope
The Service is currently offered to users located in India and to NRIs, OCIs, and PIOs accessing the Service in compliance with FEMA. Cladbe may extend the Service to other jurisdictions in the future through region-specific addenda or country-specific terms presented at the time of onboarding. Users accessing the Service from outside the supported jurisdictions do so on their own initiative and at their own risk, including responsibility for compliance with local law.
17.3 Tiered Dispute Resolution
Any dispute arising out of or in connection with these Buyer Terms or your use of the Service shall be resolved as follows: (a) initial good-faith negotiation between you and Cladbe through the grievance channel in Section 16, with acknowledgement within 72 hours and best-efforts resolution within 30 days; (b) if not resolved through the grievance channel, escalation by either party to mediation conducted under the rules of an appropriate Indian mediation institution; (c) where mediation does not resolve the dispute within 60 days of commencement, the dispute may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, provided that the buyer expressly consents in writing to such arbitration at the time of the reference. Arbitration is not mandatory for buyers, and the seat of arbitration (where the buyer consents) shall be New Delhi with English as the language.
This Section 17.3 does not, and is not intended to, override the right of any buyer who qualifies as a "consumer" under the Consumer Protection Act, 2019 to invoke the jurisdiction of the District, State, or National Consumer Disputes Redressal Commission. The choice of dispute-resolution forum lies exclusively with the buyer where the buyer qualifies as a consumer under the Consumer Protection Act, 2019.
17.4 Statutory Forums
Nothing in Section 17.3 shall prevent you from pursuing your statutory rights through the Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, the State RERA Authority, the Data Protection Board of India, or any other statutory forum vested with jurisdiction over the matter. The arbitration clause in Section 17.3 applies to non-statutory contractual disputes only.
18. Changes to These Buyer Terms
Cladbe may from time to time update or revise these Buyer Terms to reflect changes in the Service, applicable law, or our operations. Where we make material changes, we will notify you through (a) a prominent notice on Property.new, (b) an in-app or email notification to your registered contact details, or (c) a renewed-consent prompt where applicable. The updated Buyer Terms will state a new "Effective Date" and will apply to your use of the Service from that date.
Your continued use of the Service after the Effective Date of any updated Buyer Terms constitutes your acknowledgement of the update. Where required by applicable law, we will seek your renewed consent to material changes before applying them to your account.
19. Relationship to Master Policies
These Buyer Terms are a buyer-focused summary of the obligations that apply to your use of Property.new. The full legal framework governing your relationship with Cladbe is set out in four master policies, available at the URLs below:

The Master Policies apply to your use of Property.new in full. In the event of any inconsistency between these Buyer Terms and the Master Policies, the Master Policies shall prevail, except where these Buyer Terms expressly grant you a right or protection that the Master Policies do not. The Property.new-specific Buyer Privacy Notice, Buyer Cookie Notice, and Buyer Refund & Cancellation Policy provide buyer-focused detail on the Master Policies in their respective subject areas.
